Terms of Service

Welcome to Onyria. These Terms of Service ("Terms") govern your access to and use of the Onyria mobile application and related services (collectively, the "Services"), operated by BnC Consulting SAS, a simplified joint-stock company registered in France ("Onyria", "we", "our").

By using our Services, you agree to be bound by these Terms. If you do not accept these terms, please do not use our Services.

1. Eligibility and Registration

1.1 Age Requirements

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are at least 18 years old.

1.2 Account Creation

To access certain features, you must create an account by providing accurate and complete information. You agree to keep this information up to date.

1.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

It is prohibited to:

  • Share your credentials with third parties
  • Create multiple free accounts
  • Use bots or automated scripts to access the Services

2. Description of Services

2.1 AI Image Generation

Onyria is a native iOS application that allows you to create images using artificial intelligence image generation models. The Services use Reve AI technology via their API.

2.2 Ownership of Generated Content

You retain ownership of the content you create. The images you generate with Onyria belong to you and may be used for any lawful purpose, including commercial use.

However, you remain responsible for ensuring that:

  • Your input content (prompts, reference images) does not violate third-party rights
  • Generated images do not infringe on others' intellectual property rights
  • Your use complies with applicable laws

2.3 License Granted to Onyria

You grant us a limited, non-exclusive, revocable license to:

  • Process your content to provide the Services
  • Temporarily store data necessary for operation
  • Display your images shared publicly through sharing features

We do not use your content to train AI models. API usage ensures that your creations are not used for training purposes.

3. Credits and Subscriptions

3.1 Credit System

The Services operate with an internal credit system:

  • Credits are consumed with each image generation
  • Credit cost depends on the model and parameters chosen
  • New users receive a free credit allocation

3.2 Subscriptions

We offer several subscription plans:

  • Free: Limited credits, ability to earn credits through referrals
  • Pro: Monthly credit allocation for regular creators
  • Max: Maximum allocation for intensive users

3.3 Payments and Renewal

  • Subscriptions are managed through Apple's App Store
  • Subscriptions automatically renew unless cancelled
  • You can cancel at any time through your Apple ID settings
  • Cancellation takes effect at the end of the current period

3.4 Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, you acknowledge and accept that the right of withdrawal cannot be exercised for digital content provided on an intangible medium whose execution has begun with your prior consent and express waiver of your right of withdrawal.

By starting to use purchased credits, you expressly agree to waive your right of withdrawal.

3.5 Refunds

Refund requests are handled by Apple in accordance with their policies. You can submit a request at reportaproblem.apple.com.

4. Acceptable Use

4.1 Prohibited Uses

It is strictly prohibited to use the Services for:

Illegal Content:

  • Child sexual abuse material or content exploiting minors
  • Content inciting hatred, violence, or discrimination
  • Terrorist content or glorification of crimes
  • Defamatory content or invasion of privacy

Rights Violations:

  • Infringement of intellectual property rights (trademarks, copyrights)
  • Creating images of real people without their consent
  • Identity theft or deception

Technical Abuse:

  • Circumventing security measures or content filters
  • Using bots, scrapers, or automated tools
  • Attempting to reverse engineer the Services
  • Reselling or sublicensing the Services

4.2 Consequences of Violations

In case of violation of these rules, we reserve the right to:

  • Remove the content in question
  • Suspend or terminate your account without notice
  • Report violations to competent authorities

5. Intellectual Property

5.1 Onyria's Rights

The Onyria application, its design, source code, trademarks, and logos are the exclusive property of BnC Consulting SAS and are protected by intellectual property law.

5.2 Third-Party Technology

The Services use Reve AI technology under license. Reve AI and its logos are trademarks belonging to their respective owners.

5.3 License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Onyria application in accordance with these Terms.

6. Content Reporting

6.1 Reporting Procedure

If you notice content that violates our Terms or the law, you can report it to: support@onyria.app

Please include:

  • A description of the content in question
  • The URL or information to identify it
  • Your contact information

6.2 Copyright Infringement Claims

In accordance with the European Digital Services Act (DSA) and French law, rights holders may notify us of any infringement of their copyrights.

The notification must contain:

  • Identification of the protected work
  • Precise location of the disputed content
  • Your complete contact information
  • A good faith declaration
  • A statement of accuracy of the information

6.3 Repeat Infringer Policy

Accounts that have been subject to three valid copyright infringement notifications will be terminated.

7. Personal Data Protection

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.

In accordance with the General Data Protection Regulation (GDPR), you have rights of access, rectification, erasure, restriction, portability, and objection regarding your personal data.

8. Limitation of Liability

8.1 Provision of Services

The Services are provided "as is." We strive to ensure their availability and proper functioning, but we cannot guarantee:

  • Uninterrupted availability
  • The absence of errors or bugs
  • Compatibility with all devices
  • Specific image generation results

8.2 Liability Exclusions

To the extent permitted by French law, Onyria shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or profits
  • User-generated content
  • Service interruptions beyond our control

8.3 Liability Cap

Our total liability is limited to the amount of sums you have paid us during the twelve (12) months preceding the event giving rise to liability.

8.4 Exceptions

These limitations do not apply in case of:

  • Gross negligence or willful misconduct on our part
  • Personal injury
  • Cases provided for by mandatory legal provisions

9. Modifications and Termination

9.1 Modification of Terms

We may modify these Terms at any time. Substantial modifications will be notified to you at least 30 days before they take effect.

Your continued use of the Services after the modifications take effect constitutes acceptance.

9.2 Termination by User

You may terminate your account at any time from the application settings.

9.3 Termination by Onyria

We may suspend or terminate your account:

  • In case of violation of these Terms
  • In case of fraudulent or abusive behavior
  • For any legitimate reason with reasonable notice

9.4 Effects of Termination

Upon termination:

  • Your access to the Services will be deactivated
  • Unused credits will be forfeited
  • We will retain certain data for up to 6 months maximum, in anonymized form, in case of legal proceedings

10. General Provisions

10.1 Applicable Law

These Terms are governed by French law.

10.2 Jurisdiction

In case of dispute, and after an attempt at amicable resolution, French courts shall have exclusive jurisdiction.

In accordance with the provisions of the Consumer Code, you may also have free recourse to a consumer mediator for the amicable resolution of the dispute.

10.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Onyria regarding the use of the Services.

10.4 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in effect.

10.5 Waiver

Failure to exercise a right provided in these Terms does not constitute a waiver of that right.
